


Academy Membership
Rules & Regulations
DLF Golf Academy(hereinafter referred to as 'the Academy'), DLF City Gurgaon, New Delhi (INDIA). Is a sole proprietary Club owned and run by M/s. DLF Golf Resorts Ltd., DLF Centre, Sansad Marg, New Delhi, a company belonging to the group of M/s. DLF Universal Ltd. It is operating in accordance with the following Rules and Regulations:
1 Sole Proprietory Club
I) As the Academy is a sole proprietary concern belonging to DLF Golf Resorts Ltd. its membership does not confer on the members any right, title or interest of any nature whatsoever in the assets and facilities of the Academy.
II) The Management of the Academy vests exclusively in the Board of Directors of DLF Golf Resorts Ltd. and its authorised executives and employees who in these Rules and Regulations are referred to as 'the Management'.
iii) The members of the Academy have no right to be involved in the Management of the affairs of the Academy, either individually or collectively.
2. Categories of Members
The Academy offers membership for a fixed term for the use of its facilities to the following categories of persons:
A. Individual Members
1) Individuals over 21 years.
B. Family Members
i) Husband and Wife with two children under the age of 21 years. Add on child memberships are available.
3. Admission
Persons seeking admission to the Academy are required to make applications In the forms prescribed from time to time and pay the amounts specified in those forms. Management of the Academy has the absolute right to accept or reject any application for membership without assigning any reason and the applicant will have no right to challenge the decision of the Management.
4. Fees
Individuals seeking membership are required to pay a non refundable fee in advance fixed by the management at its sole discretion from time to time.
5. Entitlement
Academy facilities are available to the Academy members and DLF Golf & Country Club members. Guests, when accompanied by the Members are also permitted to use the facilities (except on certain specified days) on payment of appropriate charges.
6. Charges for Services and Food
The Management of the Academy has the sole discretion to fix charges for use by guests, and for various facilities and food, beverages and liquor and revise them all from time to time.
7. Transfer of Membership
Membership is non-transferable.
8. Cessation or Termination of Membership
In the event of any individual Member or any of his guests, spouse or children being found guilty of questionable behaviour or misuse of the facilities of the Academy, the Management may terminate his membership and forfeit the whole or part of his membership fee.
9. Membership Card
I) All members will be issued photo identity cards which will be required to be produced for availing of every facility of the Academy.
II) Loss of the card must be reported to the Academy immediately. Academy or due to use of the Academy facilities.
III) The card of the child must be surrendered to the Academy as soon as the child ceases to be eligible.
iv) Whenever due to the expiry of the term or otherwise a member ceases to be a member, all cards including those of spouses and children must be surrendered to the Academy immediately.
v) If a spouse ceases to be the spouse, such spouse must surrender the card immidiately.
10. Payment for Services and Facilities
I) Payment for all services and facilities including food, beveriges liquor hiring of equipment and guest charges etc. is required to be made in advance by cash, cheques or approved credit cards.
11. Losses, Damages or Injuries
I) The Academy sha11 not be liable for any type of injury, damage or loss caused to the user of the Academy during the course of their visit to the Academy or due to the use of the Academy facilities.
II) Every member will be liable for any damage caused to the property of the Academy or to the property or person of any executives or employees of the Academy or any user of the Academy by the Member himself or by their guests, spouses and children. Compensation for such damage will be fixed by the Management alone and shall be recoverable from the Member concerned himself.
III) All users of the Academy facilities are assumed to indemnify and hold harmless DLF Golf Resorts Ltd., its Directors, officers and employees for any loss or damage caused by or resulting from their bonafide acts or omissions.
IV) Any amount determined to be payable by a member under this paragraph shall be paid by him to the Academy within the time fixed by the management.
12. Use by Non-Members
The Management shall have the absolute right to allow the use of Academy facilities, to any persons who are not members of the Academy and without prejudice to the generality of that right to persons staying in the hotels or service apartments, or villas to be built in the vicinity of the Academy their guests and family members and members of other Clubs having reciprocal arrangement with the Academy and also persons attending functions organised on the premises of the Academy.
13. Services of Academy Employees
Employees of the Academy are not permitted to deliver food or beverages to locations away from the immediate area of the Academy building or other designated area of the Academy building or other areas if the Academy without prior permission of the Management.
14. Use of Academy Premises and Facilities
1) Entry of pets including dogs within the premises of the Academy is strictly prohibited.
II) Smoking and consumption of alcoholic beverages is permitted only in designated areas.
III) Parking of vehicles within the premises of the Academy is strictly regulated.
lV) Bringing of firearms, ammunition and weapons of any kind within the premises of the Academy is strictly prohibited.
v) Food and beverages will be supplied only by the Academy at rates determined from time to time. Catering by outsiders within the Academy premises is not permitted, except with the prior permission of the Management.
Vl) Users of the Academy will not be permitted to give any tips to the members of the staff. A service charge will be debited to the bills relating to food, beverage, liquor and other items.
v11) Children below the age of 12 years will not be allowed entry in the Academy unless accompamled by an adult who is himself entitled to use the Academy facilities.
VIII) Commercial, political, religious and other advertisements within the premises of the Academy are prohibited except with the prior written approval of the Management.
ix) No posters or petitions can be posted on any property of the Academy without prior written permission of the Management.
x) All rental equipment and practice balls are the property of the Academy and must remain on the Academy premises at all times.
xi) Academy members are restricted to Academy facilities only.
15. Alteration in Facilities
The Management shall have the absolute right to make additions, modifications, reductions, and elimination in all or any of the facilities of the Academy.
16. Attire.
I) It is expected that all users of the Academy facilities will be dressed in a fashion befitting the surroundings and atmosphere of the Academy.
II) Dress in the dining area may be casual but may be designated from time to time by the Management for special occasions and functions. Shirts worn by men must have sleeves and a collar. Swimming, jogging, gym, athletic or other types of shorts are prohibited. Shorts must be bermuda length and jeans are not permitted.
17. Effect of Events beyond Management Control
I) Currently the land under the Academy is completely free from any notice of acquisition or requisition from any government or public authority, but in the event of the land being acquired or requisitioned on a subsequent date the entire compensation will be receivable only by the owners or lessee of the land, The Academy will become liable to refund a proportionate part of the membership fee received from Members calculated with reference to the unexpired period of membership (without payment of interest) only after the receipt of compensation from the government or public authority concerned.
II) If due to the enactment of any law or issue of any directive by any government or public authority, the Academy or any of its facilities is required to be closed, the Management will do its best to resist such law or directive through administrative and court action but in the event of its failure to succeed in doing so, the membership of the Members may have to be kept in abeyance and revived subsequently. However, in the event of the Management finally failing to revive the facilities of the Academy, it will refund part of the membership fee received from Members calculated with reference to the unexpired period of membership without payment of any interest or damages, after six months of the receipt of the final order of the highest judicial authority.
III) If due to reasons beyond its control the Management of the Academy is forced to curtail the activities of the Academy or restrict the hours in respect of some activities, the Members will not be entitled to claim any compensation or damages.
IV) The Academy shall not be responsible or liable for not performing any obligation or undertaking given to Members if such performance is prevented, delayed or hindered by an act of God, fire, flood, explosion, war, riot, terrorist acts, sabotage, inability to procure or general shortage of energy, labour, equipment, facilities, materials or supplies, action of labour unions or any other cause (whether similar or dissimilar to the foregoing) not within the control of the Management.
18. Construction of Other Buildings
The associates and subsidiaries of DLF Universal Ltd. as absolute owners or lessees of the land under use of the Academy shall be free to construct buildings including hotels, service apartments, villas, structure etc., anywhere on the land or periphery of the Academy and the members shall have no right to object, obstruct or create hinerance or dispute or raise any claims in respect thereof. Members who directly or indirectly, individually or collectively raise any objections in this regard may be expelled from membership.
19. Compliance by Non-Residents
Members who are non-resident Indians, foreign companies and firms nationals or expatriates shall be solely responsible for complying with the formalities as laid down in Foreign Exchange Regulation Act, 1973 or its statutory re-enactment or replacement for the time being in force, Reserve Bank of India Act and rules made thereunder and all other applicable laws for the time being in force governing the remittance of payments to the Academy and all refunds to be made by the Academy. Members shall inform the Academy forthwith whenever there is any change in the residential status of themselves, their spouses or children.
20. Total Number of Members
The Management will be free to enroll as many members as it considers appropriate.
21. Suspension of play
Normal use of the Academy will remain suspended for a few days to facilitate the conduct of the golf tournaments and events from time to time.
22. Game Rules
Detailed rules governing the use of the Academy which are currently in force are given in the Schedule written hereunder.
23. Rules Not Exhaustive
These rules are not exhaustive and the Management shall have the absolute right and sole discretion to add to or amend them from-time to time and all such additions and amendments will be notified by displaying them only on the notice board of the Academy and shall become immediately binding on all the users of the Academy.
24. In these rules, unless there is anything repugnant in the subject or context -
a) words importing the masculine gender shall be taken to include females;
and
b) Words in the singular shall include the plural, and vice versa.
25. Arbitration
Any dispute arising between the Management of the Academy and a Member shall be settled amicably by mutual discussion, failing which the same shall be settled through arbitration by a sole arbitrator appointed by the Management of the Academy, Such arbitrator shall be a retired judge of a High Court or Supreme Court and the arbitration proceedings shall be held preferably at the office of DLF Golf Resorts Ltd. in DLF City, Gurgaon, Haryana.
SCHEDULE ABOVE REFERRED TO
A. ACADEMY
1. GENERAL
I) The Director of Golf has the absolute right and discretion to enforce these rules and determine the timings of play and the days for the closure of the academy.
II) Practice is not allowed in front of the designated teeing area.
III) Use of the academy for any purpose other than practising of golf is prohibited. jogging and recreational walking is also not allowed.
IV) Whenever there is lightning in the area, practising of golf has to be stopped immediately.
V) Children under the age of twelve years must remain under adult supervision and kept away from the hitting area and mechanical equipment.
VI) Special golf events organised by the Academy take precedence over normal play.
VII) Management has the sole discretion to limit the use of the hitting bays in order to prevent hitting bays being monopolised by one person or group unfairly.
VIII) Operating hours are at the discretion of Management and will be posted at the academy.
ix) The swinging of clubs is confined to the hitting bays.
2. BOOKING AND REGISTRATION
I) At Management's discretion advance bookings for the range may be required from time to time.
II) All registration and payments are to be made at the Academy Pro Shop.
3. CHARGES FOR USE OF FACILITIES
I) Members are entitled to use the academy by paying the appropriate charges determined by Management.
II) Subject to restrictions imposed from time to time, Members may bring guests to play along with them on payment of range fees and other charges.
III) All practice balls must be hired from the academy alone.
IV) Players are free to bring their own golf club sets or take them on rent from the Academy.
V) All golf related equipment can also be brought by the players themselves or taken on rent from the Academy.
4. NIGHT GOLF
I) Lights are to be turned on and off by designated staff only.
II) Specific charges to cover expenses connected with night golf operations may be payable by all persons including Members and guests as fixed from time to time.
III) Night rates may be higher than the day rates and are subject to change from time to time.
IV) Initially the night golf will be operational only on specified days of the week.
V) The Management reserves the right and at its sole discretion may call off night golf on any day without assigning any reason whatsoever.
5. STOPPAGE OF PLAY DUE TO RAIN
If due to sudden rainfall, the use of the range has to be temporarily stopped the Academy will refund all hiring charges.
6. ATTIRE
I) All those who enter the academy have to be attired appropriately.
II) Gentlemen are expected to wear trousers, or just above knee shorts and collared T-shirts.
III) Jeans and track suit pants are not allowed.
IV) Golf shoes with soft spikes alone are permitted. Metal spikes are prohibited.
7. GOLF LESSONS
I) All players are liable to pay the coaching charges in respect of the professionals who teach them.
II) All golf lessons must be booked through the Academy in advance.
III) Payment for golf lessons must be made at the time of the lesson.
IV) All lesson fees are inclusive of practice balls.
